As far as I know priority date can ony be transfered when the I-140 is approved. Go ahead and get both I-140 approved and use the earlier date towards the new one at the time of filing of I-485.

This sounds like injustice to me.
Although I got lucky and got my GC however I honestly wanted them to do it in the
order of Priority dates.
My best wishes are with everybody.
May everybody get his/her GC before Sep 30th.

Hello,
If parents have US Visitor Visa, can they travel to the US on British Airways via London Heathrow airport without any transit visa requirements.
They have a valid visitor visa till 2018.
Does UK have any conditions which one needs to know

Hello,
I will be getting married to a H1 holder in India and because of the time involved in obtaining a marriage certificate, am planning to leave shortly after the wedding with my existing B2/tourist visa. What are my options of applying for a H4 once I do that - would I have to come back to India to apply for that, or can it be done from Canada/Mexico - are there any risks pertaining to intent of travel associated with such an action. Thanking you in advance for valuable help in this matter!
You would be better off stamping your H4 in India, my 2 cents. Especially B1/B2 to any non-immigrant visas most of the time is a mess in my opinion.

Please do not go for stamping if it can be avoided, as embassies are very frequently giving form 221(g) for additional administrative processing which may take few weeks to several months.

Today I found out there was a soft LUD on my I485 application. I am not sure what it is. How can I find what is going on with my I-485 application. Befre that there was a soft LUD on my travel document which I file in 2007 after that I did not file that. I just want to know what is going on with my application. Please let suggest.
Probably it is the pre-adjudication. I had soft LUDs on mine and spouse's 485 for the last 2 days. Recently got my I-140 approved.

Sorry folks, the question may have been asked before.
Does I-140 have to be approved before using AC21? In my case, I140 has been pending for 1 year now, but got EAD recently.
If I use AC21 to move to a new job in 6 months, can employer pull out the I-140 ?

your wife is fine, with H1 transfer there is no need to file H4 transfer. She is not out of status.
If she had presented the new H1 approval she would have got I-94 based on that date. So just apply for her H4 extension now.
And no issues with filing I-485

There is no AC21 for derivative applicants. She can join any employer at any time. AC21 comes into picture only for primary applicant. Derivatives get almost a virtual GC in terms of EAD.

The other day had a friend at my place and I felt like throwing him out of my house. These guys are crying by their asses days and night. Believe me he is the guys whose wife drives him to work because his DL expired and PA DOT is not issuing him License because he has less than 1 year visa. But he was talking this government, that government..... I asked him to keep quiet and watch, if we are successful you'll get a free ride, if not then keep crying through your ass, you're doing it anyway!!!!

The H-2B visa program is vital to America�s small businesses and thus to America�s economic recovery. The H-2B program is capped at 66,000 visas per year. This is the same arbitrary number set by Congress in 1990. The visa allotment is split equally between the winter and summer seasons. Unlike the hiring of American workers, small business owners must go through a tough application process to hire foreign workers through the H-2B program. Employers must prove to the U.S. Department of Labor that there are no available U.S. workers to fill vacant short-term positions. H-2B workers go home at the end of the season. They cannot, and do not, stay in the U.S. permanently through this program.
Without access to more temporary H-2B workers, many small businesses will be extremely short-staffed this year and could be forced to close. For small businesses, relief must come now so that America�s employers can get the seasonal temporary workers they need to help in America�s economic recovery.
RELIEF NEEDED:
� An H-2B visa returning worker extension will go a long way in helping small and
seasonal businesses survive in the short term. The extension would provide
emergency relief by exempting from the cap H-2B returning workers who already

As long as you are qualified and confident to do the job, you are in contention. However, the question is do you have a job and is your employer willing to sponsor an H1B for you.
