My nationality is Indian. Presently i am residing in USA . I have " Advance Payrole Document " . I am planning to travel in this February 2011 from " Atlanta -> Frankfurt -> India(Hyderabad) " and return is in May 2011 from " India(Hyderabad) -> Frankfurt -> Atlanta " in lufthansa airways.
So shall i go for this round trip with a valid " Advance Payrole Document " only ? or i need to have " Air Transit Visa ? If i need Air transit Visa could you please let me know how to apply and what documents i need to submit .
please help already buyed tickets from lufthansa website. non refundable ticket. before that one time i cancelled ticket. airport transit visa shall we apply by post/mail ? in person cant go because very far totally 30 hors drive that too with infant driving not possible . please help ?

A friend of mine is a citizen from a non Visa-waiver country, married to an American. They've been married for two years and she is expected to receive her green card in a few months at the embassy of her country of origin where she still lives. Because of abuse issues, she wants to separate asap but is afraid he might retaliate by trying to prevent her from receiving her green card. Is that possible, or should she wait until she has the Green Card in her hands? Thanks!

Follow-to-join can be applied anytime after the filing of I-485 even after approval as long as Visa Number is available at the time of filing. Visa number's availability depends on the Department of State's Visa Bulletin.

How will removing country limits help China, India and ROW.
Has someone done any calculations on visa date movement.
We should have some comparison on this because some of us from China against. I seen many ROW against.
Does it help only Indians or everyone by how much?
I see these calculations bringing Indians, Chinese and ROW together.
the truth is this.... some of the chinese are against removal of country limits becoz they do not care if it helps them..... they r simply opposed to removal of per country limits becoz they cannot see india getting any benefit..... its the age old chinese mindset which cannot be changed with numbers or calculations...... otherwise just think for u'rself...... if china is retrogressed as evident from monthly visa bulletin .... & removal of per country limits will create 1 queue for everyone..... then y would some of these chinese be opposed to the removal of per country limits.....

My wife's and mine EAD renewal was applied on the 23rd of July (company lawyer delayed filing). I received mine in 30 days but my wife's case is still pending, though I am working on my H1 and don't need it. My wife's current EAD expires today, is there anything we can do to get the process to move faster or get her case expediated other than just wait till 90 days. There are lots of people I know who received their EADs even though their applications were sent much later. If the discontinuity is long, my wife may loose her job.

I was wondering if anyone has any info on the job
market for international students in NY. I will be graduating
in Dec and will be on the job market soon.
Some of my friends say that there are jobs to be had but
not many are keen on sponsoring H1, even non-tarp firms.
Can anyone confirm/refute this?
market is tough but dont give up & just sit back though - for what its worth look aggressively & hopefully you have opt for 1+year available so they get a chance to look at you

Hi..I was in a similar situation. Best thing for you to do is File for F2. Make sure you send dependent I-20 issued from your wife's school with your F2 application. Pay slips are only needed for changing status from H1 to F2, in your situation. No payslips are needed when you change status back to H1, because you are on F2 at that time. hope this helps.good luck.

I am applying for my change of status from h1b to Green card based on immediate relative who is spouce and a US citizen.
On the form 485 , to mentions the non traffic citations do I need to mention the following citation that I received last year.
1) Summary charge - Citation for Fishing without Fishing License in State of PA
2) Summary Charge - Citation for False statement to the park officer about possesion of the Fishing License.
Do I need to mention these citation when filing for form 485 ? (150$ fine)
Is this going to affect the Immigration application? (200$ fine)

Ask your company if they can do your H1 extension under CORP thus the legal entity does not change and there should be no issue.
It seems like for your initial H1, it was a mistake on their part that they filed you H1 under CORP while you were actually paid by the BANK. Can you ask them why they did that in the first place?
If it's a mistake on their part, there's no reason why you should suffer and they must take every effort to help you out. Work with them, talk to your manager, his/her manager and explain them the issue. It's an internal thing and I'm sure can be worked out.

If the petition is approved under Consular Processing then they need to leave the country. Other wise no. The reason for Consular Processing would be not maintaining the status continuously.
If you get I94 along with the approved H1B then you are fine. If not, you need to leave the country and get it stamped. Your other friends might have not got I94 along with their approved I94
