My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.
If she transfer her H1B to new company.
1. Can she ask for 1 year extension based on her pending labor ? Does she need to wait till the labor gets approved ?
2. Can she use Premium Processing for H1 transfer?

I just found this link (http://immigrationvoice.blogspot.com/) where this topic is already covered. Mods, please remove my post (and maybe it would make sense to create threads specific to the USCIS/DOS mess up to - at the moment it does not look very organized to me and it is hard to find information. Maybe sub-threads with "law suit", "publicity" would channel comments better?)

I only read about an article in two online newspapers but believe this whole topic should get significantly more attention. I do not know if that is going to help to get this started but I sent an e-mail to our local TV stations and hope that some may be interested and even pick it up. Again, no idea if this is going to work but I assume that if they get more e-mails regarding the same topic, interest will come up....

With having many international operating companies in the U.S. who all employ legal alliens who are going through the "greencard process" to become legal permanent residents, the Department of State (DOS) and the U.S. Citizenship and Immigration Services (USCIS) have destroyed many plans, caused significant financial loss for applicants and very likely acted against the law. I think this would be well worth a few minuted report - everybody is talking about the pain that the illegal immigrants go through but (without taking away anything from that), the pain of legal alliens having to deal with the willful behavior of USCIS and DOS is not much better.

I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.
You will need to have the petitioner file an amended petition only if there has been a material change in the terms and conditions of your employment.
Compare the job duties (not just job titles) of the original and new job to determine if they are in the same Standard Occupational Classification (SOC). See, Find Occupations (http://online.onetcenter.org/find/). If the jobs are in the same SOC, they would both have the same prevailing wage and no material change has occurred. In that case, you may only need to get a new LCA. All LCAs take up to 7 business days to get certified by the DOL. There is one way to find out if CIR is any good for EB - by looking at the bill when it is proposed bill and amendments. It will be suicidal to assume that CIR is somehow bad for us, and incriminate any effort for CIR. My point earlier was not that CIR is bad for EB, but about the actual reason for Sen. Reid's recent comments, just to set the expectations straight.

I hadn't noticed the little white spot - you are quite right and I'll zap it.
This version of the image isn't super sharp. This is the first one I've tried to upload to this forum and I had some trouble doing it. It kept telling me that my file size was too large so I wound up having to reduce the quality a fair bit to get it uploaded within the file size allowed.
It is actually hardly cropped at all. The original is quite a bit sharper than this but then again the camera was not a DSLR but the sony F707 which is one of the first 5 megapixel cameras. I recently upgraded to an 8mp Nikon 8800 but am very disappointed with the resolution of that camera in the telephoto range. I see a Canon DSLR in the near future.

Guys
Just curious to know whether anybody received the physical card with out a CPO email or status. Did anybody with just "Welcome" email and status receive cards yet?
Just checking whether NO CPO status/ email = no card.
I received the "Welcome" email, status and the physical letter on Tuesday but no card yet. Any body in the same boat? (I understand that it takes about 1-3 weeks but many have received cards with in a week)
The reason I am asking is my I9 expires month end and HR is on my back for the updated doc. They would rather see a card than a letter which has no expiration date :)

You've been approved per your message below. So all it means in your case is that the USCIS has to let the Visa Center and/or Dept of State know that.

Guys,
I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

Not sure why you want to go to Consulate in India and why you have to mention to them about the 22 days. H1 will not be processed in the Consulate in India, it will be processed only here. If you are saying that in future when you go to the US Consulate in India for stamping then its not needed to mention about the 22 days, since you filed before the I-94 expiration. Do have a soft copy of the FexEx receipt saved for your future use.

it is my understanding that she just needs your H1 approval notice, employment letter, your pay stubs etc. I don't think she even needs her H4 approval notice for her H4 stamping. I am very sure that only your H1 related documents are needed(she needs your original H1 approval)-please check with your lawyer
