If you get laid off, hopefully you have enough years on your initial 6 yr H1 to work with another employer an apply for a new labor and get back on track.

My employer filed the PERM with EB-2 in September 2007. It was audited in November. Still waiting. I have the fear I could get laid off. If this will happen before the Labor Department approval, and before the 1-year renezaw of my H1-B (exp. Sept.08), what will happen? Do I loose everything?

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

swft3d max is only a plugin for 3d studio max to allow import export between the two. you need the trial full version unless you have 3d studio max.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.

Not sure what to say. But I believe in your original H1 petition requested dates of employment were only for one and a half month and I think you will get only that. Unless attorney files an amendment and documentation for additional 3 years. I dont think USCIS will even look at I-140 approval since it was not eve part of the packet

Yes, its possible. The only conditions are - your port of entry MUST be Newark, NJ & you MUST rent the apartment at Whitehall Gardens, Somerset.
If you dont meet any of these, USCIS will not allow you to convert from visitor to H1B

I have completed 3.5 years of my H1B and am looking at the possibility of applying for GC either under EB2/3.
After my 12th, I did a 2 year Diploma in Business from Australia and then did a 2 year MA(History) in correspondence (open uni) from India and also a 1 year PGDCA by correspondence.
I have more than 10 years of IT experience to go with my 12+2(fulltime)+3(correspondence)years of education.

Hi,
My 485 status on USCIS site is showing Document production or Oath Ceremony. The status changed on 7/8/2010. What does this status mean. Does this mean approval? How long does it take to recieve the actual card once the case enters to this state.

It was a mistake by the guy who stamped I-94 (at CBP).
Her H-4 must be expire on your expiration date.
You need to go to nearest CBP office to get it corrected.
She need deferred inspection to get it straight. USCIS will not do it.
OR Do nothing about it and file H-4 extension along with your H1B extension.
If you do not extend her with your petition, even if she have valid I-94, she may end up in trouble later.

My wife is on H4 visa (expiring in 3-20-2013 since she got 5 yr multiple visa). Recently she visited Kuwait and on her re-entry she was given entry (on her I94) up to 3-15-2013 (up to 5 days prior to her visa expiration). Will she also need extension in this case along with my extension or can she stay in US till 2013 with out extension Thanks.

Incase there was adelay in degree due to backlogs what information has to be entered in section 17 DS-157
enlisting of all educational institutions attended" section on DS 157 form, I completed my degree late due to backlogs .i.e. I was supposed to complete it in 1996-2000 but I completed it in 2005 due to backlogs and since I had started a job already during my studies.
Now i am confused weather I shall put 1996-2006 or 1996-2000 on dates of attendance of my university in DS 157?
