    Hi,

    Thanks for your response..

    So what if DOL doesn't respond before the H1 expires..Can the Employer file for H1 Extension without an approved LCA ??

    And if the LCA is denied because the DOL doesn't recognize the FEIN what options have we got..Can the employer reapply for LCA or just submit the Info and wait for info from DOL ??

    Hello,

    My I-485 application was filed under EB3 category when I was working for my previous employer (PD - October 2006). I changed my job in August 2008, but never sent any documentation for AC21. I now have close to 8 years of experience and also a masters degree (MBA) from a reputed univeristy here in the US.

    Now that EB2 dates are so close to October 2006, is there anyway I can port my application from EB3 to EB2? I can initiate this discussion with my current employer and may be able to convince them to help me. But I want to know exactly what needs to be done.

    Since you are using the AC21, your job must be in the same or similar category. It does not matter how much qualification/experience you have. The job requirement should need that. Since you are using AC21, there is no way you can port from EB3 to EB2 in the current job. If you want to go for EB2, you need to start from scratch and the job requirement really needs a masters.

    I just called USCIS to check the status of my case and the Immigration Officer said it is in EB-1 category. I know my case is EB-2.

    I asked the IO to see if i have send any paperwork to rectify their mistake, but she said USCIS will automatically adjust the category whe it picks up the case for review

    I am confused. Please Advice

    It depends on how many cases that will be pending approval on October after the surge of applications this July and August.

    I think it wouldn't be current for some countries specifically India and China.

    I came to the US on F1 for MS and then trasferred to another college to pursue my PhD. During this time my F1 visa expired, but I am maintaining my legal status as my I-20 is valid. I got married last year and my wife who originally came on F1, is now on H1.
    I am going to planning to go to India in end of April and need to renew my F1 visa. What are the chances of my renewal getting refused, due to my wife's H1 (dual intention) status? What documents if any, can I show in order to prove that I have intentions to come back to the US?
    I need to get a visa interview date soon, so please reply as soon as is convenient.

    Should not be a problem. just keep some property docs.
    Worst case, they will give you H4 visa. Once you enter on H4, you can file I-539 to change from H4 to F1.

    How long will it take to get the receipt number when we apply for H-1 extension? And how long will it take to get the decision?

    I am assuming when I have the receipt number, I can be considered to be in legal status and keep working with my present employer though I-94 is expired.

    Please help with your answers/suggestions.

    Hello,

    My wife is currently on H4 status. (Just the I-94, her visa expired last year October). She started her MS in Fall 2009. She already competed 2 Semesters of MS on H4 visa. We applied for her Change of Status to F1 visa in March. According to the USCIS processing dates, she will get the COS approved approximately in June 1st week.

    She will have to travel to India this summer. The question we have is,

    is it advisable to wait till she gets her F1 COS Approved and then go to India for F1 Stamping ?
    or abandon the F1 COS and go for F1 stamping directly in India ?

    Please advice if there are any risks involved here.

    Do they really know our name check status in local INS? When I spoke to NSC an year back, they said that my name check is done and waiting for visa numbers. when I went local INS office recently, she simply checked the online status (which we used to login and see) and she told that my name check is pending. It's been 4 years since I filed my 485, how is this possible?

    Hello All,

    My wife is in a similar situation where she was on F1 till Sept 31st (OPT) and now on H1-B (since Oct 1st). I have also added her as a dependent in my GC application and hence she has received her AP. We are planning to go to India in the month of January. Can she return back using AP? I have read in other threads that one can return using AP and there is no need to stamp your H1-B visa in the passport. But in her case, the H1-B visa is not stamped even once. Can this be a problem if she enters using AP? I would appreciate your advise in this matter.

    Are there people who are current now, who have no Priority Date mentioned on the I-485, EAD and AP receipts? (i.e. the PD box is blank)

    The priority date is shown on my I-140 receipt, but not on the aforementioned documents.

    Does anyone know how to correct this problem? Thanks much.

    Thank you for the reply. My confusion stemmed from whether i can use my US License as my id for gaining the license. Or whether somehow my A# or I94 number had to be noted on the license/certificate in order to use it at a later point for the green card process.

    Most states require birth certificates, proof of citizenship and/or residence, and a driver's license or other photo id. You need to produce your immigration documents depending upon the State

    Hi:

    I received RFE (employment verification letter) from USCIS, texas center two years ago. I was still employed by the company who filed my GC application at that time. So the company replied and my case status was updated. But my PD was not current, so my case is still pending until now.

    I lost job recently, if my PD became current in early 2010, will USCIS EVL me again?

    I know no one can predict how USCIS works. I just want to check if anyone had experience that was checked employment status twice?

    Today I will be giving a presentation on immigration law along with my colleague, V. Thomas Langford, to the Air Force JAG serving at Travis Air Force Base in Fairfield, California. The Air Force JAG Corps are lawyers who provide legal advice to those serving in the Air Force.

    Our training today will focus on the basics of immigration law. We will be covering family-based immigration law and outlining the procedures involved in petitioning for a family member to immigrate to the United States. We will also be talking about the Violence Against Women Act ("VAWA") and how an individual may self-petition for immigration status if he or she has been the victim of abuse or mental cruelty. Finally, we will discuss the naturalization laws as they apply to those serving in the military at a time of a conflict.

    It seems that I always learn something while preparing for a presentation. While preparing for this one, I learned that staff from USCIS in Sacramento go to Travis Air Force Base twice a month to interview applicants for naturalization and administer the oath of citizenship on the same day. Kudos to USCIS for taking the time to do this. USCIS has an entire website page devoted to military naturalization ceremonies (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=7b309f22ae951210VgnVCM1000004718190aRCR D&vgnextchannel=0a9ab58f71e14110VgnVCM1000004718190a RCRD) performed in May 2009.     As you will have a valid H4, you can try using H4 at the port of entry but it doesn't matter even if you use AP. If the Officer at the PoE objects or raise questions pertaining to your work status then you might want to use AP. Your status will not affect your spouse (or entire family) Green Card process.

    Your status depends on your spouse's status. If your spouse is on H1B; you can always convert your status to H4 even if you use AP at the port of entry.
